Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Mesh8 application and website (the “Service”) provided by Claremont Labs LLC (“Mesh8”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are using Mesh8 on behalf of a company, you represent that you are authorized to bind that company to these Terms.

The Service

Mesh8 is construction-management software for construction teams, including project and phase tracking, scheduling, crew and labor-cost management, and invoicing. We may add, change, or remove features over time.

Accounts

You must sign in through a supported authentication provider and keep your account secure. You are responsible for activity that occurs under your account and for the accuracy of the information you provide. Notify us promptly of any unauthorized use.

Plans, billing, and free trial

The Service is offered through paid subscription plans, billed monthly or annually. Current pricing and what each plan includes are shown on our pricing page and at checkout. Payments are processed by our payment provider, Stripe; we do not store your card details. Prices may not include taxes — where required, we collect applicable sales tax or similar charges in addition to the listed price.

New subscriptions start with a free trial as described at signup. We will email you a reminder before your trial ends and your first charge occurs. If you cancel before the trial ends, you will not be charged.

Renewal and price changes

Subscriptions renew automatically at the end of each billing period — monthly plans each month, annual plans each year — until you cancel. For annual plans, we will email you a reminder before each renewal, including the renewal price and how to cancel. If we change the price of your plan, we will notify you by email at least 30 days before the new price takes effect; price changes apply from your next renewal, so you always have the opportunity to cancel first.

Cancellation

You can cancel your subscription at any time, entirely online, from your workspace’s billing settings — no phone call or email required. Cancellation takes effect at the end of your current billing period: you keep full access until then, no further charges occur, and you can resume your subscription any time before the period ends. We will email you a confirmation when you cancel.

Refunds

• Monthly plans: charges are not refunded or prorated for partial billing periods. Cancel any time to stop future charges.
• Annual plans: if you are not satisfied, contact us within 30 days of any annual charge — including renewals — and we will refund that charge in full. After 30 days, annual charges are non-refundable, and canceling keeps your access through the end of the paid year.

Failed payments

If a renewal payment fails, we will notify you and retry the charge over a reasonable period. If payment continues to fail, we may suspend or cancel your subscription. You can update your payment method at any time in billing settings.

Your content

You retain ownership of the data and content you submit to the Service, including your projects, customer and worker records, and photos (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service. You are responsible for Your Content and for having the necessary rights and consents to provide information about third parties (such as your customers and workers).

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of others’ rights.
• Upload malicious code or attempt to disrupt or compromise the Service.
• Access the Service through unauthorized means or probe its security without permission.
• Reverse engineer, resell, or misuse the Service beyond what these Terms permit.

Fair use of storage and unlimited features

Where a plan includes “unlimited” storage, projects, or similar features, “unlimited” means unmetered use in the ordinary course of running your construction business on Mesh8 — such as jobsite photos, project documents, and records tied to your projects. It does not mean unrestricted use for any purpose. In particular, you may not:

• Use the Service as general-purpose file backup, archival, or media hosting for content unrelated to your projects and business records.
• Store or distribute files on behalf of third parties who are not members of your workspace, or resell or share storage capacity.
• Upload content through automated means at volumes far outside normal use of the Service.

If your usage substantially exceeds what is typical for teams on your plan or otherwise indicates abuse, we may contact you to find a reasonable solution, and we reserve the right to throttle uploads, impose storage limits, or — after notice and an opportunity to reduce usage or export your data — suspend the affected features or your account.

Third-party services

The Service relies on third parties such as authentication, hosting, and storage providers, and may integrate with services like payment processors or accounting tools. Your use of those services may be subject to their own terms, and we are not responsible for them.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. You can request a full export of Your Content at any time by emailing support@mesh8.app, and we will provide it in standard formats within a reasonable period. After your subscription ends or your account is closed, we retain Your Content for 90 days so you can still request an export or reactivate your workspace; after that we delete it, except where we must retain records to meet legal obligations.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data, calculations, or financial figures it produces are accurate or suitable for your specific needs.

Limitation of liability

To the fullest extent permitted by law, Mesh8 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us, if any, in the twelve months before the claim.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
